Primary appeals - Y3 class size limits

Currently abroad out of the UK education system so in desperate need of help to navigate the system. DD just been given a place for Y1 for September. Other DD is on waiting list for Y3 (currently number 6). When does the eldest become a sibling - now or in September? And are there limits to Y3 class sizes - am wondering whether it's worth appealing......

Just to add a little to tiggytape's comment, although there is no legal limit on class sizes for Y3 and above most appeal panels will be uncomfortable with taking a class beyond 33 or 34 pupils.

Thanks both. We live 0.2m from the school so was hoping she would become a sibling asap as she'd surely be near the top of the waiting list rather than 6th. I will appeal then, not least because I'm not convinced by the admissions team - I called on Friday to see where the girls were on the list and was told the youngest was still number 1. Then in less than 30 mins my sister in law in the UK received a call to say we were being offered a place. And when we first asked to put them on the waiting list in March this wasn't done until May.
