ICS Appeal

Hi all, I have my ICS appeal next Friday! Basically My daughter didn't get place by a whole 2m! My LA measures 'as the crow flies'. ...last time I checked humans didn't have wings! Anyway I know of a family whose twins got into the school (2meters closer) by the measurement 'as crow flies' yet she has to walk pretty much past my house to get there! My walking distance is a good 30m less! How can this even be allowed to happen!?
Any one offer advice?

Unfortunately, if they state 'as the crow flies' (very common) and have measured 'as the crow flies' and your DD misses out by 2m on that measurement, you haven't got a case. You'd only have a case if you knew that the twins lived further away from the school than you 'as the crow flies'.

I agree with Lougle.

Most LAs use straight line distance as it is less likely to be challenged than shortest walking route or similar. LAs that use shortest walking route regularly face challenges from parents who believe they have found a shorter route than the one used by the LA. As your LA uses straight line distance the fact that your walking distance is shorter is irrelevant, as is the fact that you only missed out by 2m. I'm afraid your appeal is likely to fail. Sorry.

It's also possible those twins got in not because of distance but because they were in a different admissions criteria to you.

No hope is a little strong. It is always possible that something will emerge during the hearing that shows a mistake was made. But you need to be realistic about your chances.
