School appeal question

My daughter is in Y5 and i am about to appeal to get her into school with my other dd who is in Y2. The sibling link wont work as it apparently only runs down!!!!

At the school they have a PAN of 60 per year, which they already have, but they have moved one child from 1 class to the other, making the numbers 29 and 31.

My question is do they then have to fill the space in the class that holds 30 or are they allowed to have a class of 29?

Any help would be appreciated :)

No they don't have to admit another child to that class. They can organise classes however they want. However, the obvious question to ask is if one class can have 31 children why not both of them. I would ask that at the appeal.

I agree with PRH, the school in some respects are shooting themselves in the foot unless they have a very good reason for having 29 and 31 in the two classes. If the answer comes back they moved the child to stay with friends - very poor answer. However there may be a very good reason why the child was moved, you need to ask that and expect to get a full answer.
Do you know the answer why the child was moved?
If there is not a good reason given then I think you have every reason to ask the panel to accept that if they can cope with 31 in one class then they can cope with 30 in the other.
You should be asking the question in stage 1 of the appeal, when the admission authority is making their case not to admit.

"and expect to get a full answer". You might get an answer, but surely there might be limits to what you can be told due to the moved child's rights of confidentiality?
