In year school appeal

Hi all looking for some advice please. Dd is in year 2 has dx of ADHD and gets no support at all no statement etc at current school and as result has very low self esteem and is currently very unhappy teachers not understanding her etc etc. Few months ago we moved house not far away but put us in different catchment area. Dd desperate to go to catchment school as she so unhappy in current school. Applied for place but full and she 2nd on list. No spaces have come up in her year group in last 2 years. I can't swap her to any other school as I have epilepsy and can't drive and dd2 also has additional needs. Just wondering how successful we will be at appeal due to infant class size legal limit? As it take 6 weeks to get to appeal it will be start of May before appeal anyway and then only one term left before year 3 will they take this into account at appeal? So in effect class
Numbers will only be one pupil over infant class size limit for about 7 weeks before summer hols
Dd so unhappy, her school have truly broken her spirit this year and is heartbreaking, doc said if she gets any lower he will sign her off sick :(

appeal at this stage would probably not be successful due to infant class size regs so unless you can prove a mistake has been made and your child should have got a place there really isn't any room for a successful appeal however if you manage to get a statement that names the school you wish her to go to that would change things but getting a statement takes time.
I think in your place I would take dd out of school and home educate if at all possible and then re apply for a place for September when infant class size regulations are no longer in effect, you would probably again be refused a place but you would stand more of a chance at appeal. I would start the process of getting a statement as well as this would help you get things in place at the new school as quickly as possible. Good luck.

Thanks - unfortunately can't home educate as hubby works full time and dd2 has to attend child development centre very week with me so would be very difficult. They said can appeal each school year so will do it now and again in sept. School won't help at all with statement etc and they very hard to get in our area unfortunatlwy
