Pregnant 12 weeks after returning from MAT leave

Hi found out I was pregnant last week I'm only about 5/6 weeks pregnant at the minute I went back work 16.03.21 my daughter was 7 months old when I returned they said I can still have the other 2 months of but I took my maternity pay early so it was running out so I decided to just go back .
Would I be entitled to maternity pay again ?
I have been with the company for 3 years now I've just heard you need to be back for so long before they will let me have mat pay again
Just confused some people saying I will and some saying I may not I have been back now for 12 weeks and I don't plan on telling them till I'm at least 13 weeks

Pretty sure they don't get to decide. They might if its enhanced pay but they can't stop you getting SMP

You need to check your contract as I know where my husband works you have to be back for so long before they give it again. Of course this is probably only for the enhanced, so you should be able to claim the basic.

Is there someone in HR you can speak to in confidence. They have a responsibility to keep it confidential and not tell your managers etc.

You would be entitled to statutory pay, but if your workplace offer an enhanced package you may not be entitled - and only they can tell you that.

You will get SMP as thats based on your pay when you are 25 weeks I think from memory (it does say on the website)

As for enhanced pay you wouldn’t get it at my company you have to be back a full year from when you returned. You will have to speak to HR about the enhanced pay, I know teachers is 1 term they have to be back for.

I wasn't on enhanced pay just the basic maternity pay but the government pay that to employers don't they anyway ? I'll see what they say by the time I tell them I would of been back for nearly 5 months x

You'll get smp. I went back to work 12 weeks pregnant with number 2 and I'm still entitled to my full year off and statutory maternity pay. I didn't tell work until I was 20 weeks as I was wfh so noone knew. It worked out fine even though I was worried about being judged!

You don't lose your entitlement to SMP by taking it. So you are entitled to it again for this baby.

Don't feel bad or cheeky about it. Or at least feel less cheeky than me; when I returned to work after Ds1 I was 12 weeks pregnant with Ds2.

Thank you for replying back I was just worried as some of my work friends said they might let me have it again and some say they may not 🤦🏻‍♀️
Yea I won't telling them for a while yet anyway X

They don’t have a choice in whether you take it. You are entitled to SMP as you will have been employed by them for long enough before this may leave (previous mat leave counts as employed)

I’ve just gone back from 12 months mat leave at 3 months pregnant. They can’t stop you having leave or SMP.
