Refusing to go toilet at Pre-school

My 3 year old son recently started pre-school, 5 days a week 9 till 12. On his first day he wet his pants and the staff had changed him, they had asked him if he needed to go to the toilet but my son had insisted he didn't need to go. We chatted about it later and he told me he couldn't go to the toilet because mummy wasn't there to take him.
On his second day I took him into the toilets, we had a good look around and chatted about how he was a big boy now and could use the toilet by him self and use the step to reach the toilet etc when I picked him up later he was dry and dry for the rest of that week so I assumed he was now using the toilet. He was dry Monday Tuesday and Wednesday of the second week so again I assumed he was using the toilet but it turns out he just didn't need to go or was holding it in until he got home. Thursday and Friday the staff told me he had an accident, again on Monday, it was then I found out he is refusing to use the toilet full stop, he has never used it! He is potty trained at home, he uses public toilets when we are out but for some reason will not use the toilet at school. The staff always ask him and have gone in with him but he refuses :( I have asked to take his potty in, thinking that might help make him feel more comfortable but was told it is against regulations. I don't know what else to suggest other than go up to the school and take him myself half way through the morning? But I don't think he would let me leave again if I did that, we still have a few tears in the morning :(
