I don’t understand? If the care home was unable to meet his needs, then it would be unsafe to allow him to be discharged from hospital back into the care home.
While I empathise hugely with the situation, the petition is utterly flawed. A care home place is not a tenancy so doesn’t confer the same rights. The real problem is the crisis in the care sector.

A care home has no legal obligation to take anyone or to keep a room available for them during long hospital stays. Truth is while a resident is in hospital often they don't get any money. I know everyone thinks care homes are raking in the money but often that's not true. It's also very common for someone who has spent time in hospital to have different needs when they return and some homes don't have the capacity to deal with those needs. Someone who has had sepsis for example may have less mobility, more complex medical needs, etc. most care homes don't have medical staff available 24/7. This means if someone needs nursing care they will likely have to move homes, in order for them to receive the appropriate safe care. Care workers get paid minimum wage they're highly trained but they're not nurses.
