Photos of child on Internet (Long one)

Last year my daughter was 7 she was in a show with a local stage school. She played a little girl going to bed about to be told a story and later she was a dwarf (the story was snow white) A few weeks ago I discovered a website for this stage school and found a photograph of my daughter in her pyjamas with her full name above it, displayed for all and sundry to see. THere was also about another 100 photos of children (the rest of the cast)aged up to 11 years old onthis web site. I contacted teh head of the school and she informed me that she wasn't doing anything wrong as the photos were taken in a public place. I went to the police and they told me that this was right as it was a commercial webs ite fo the school I couldn't do anything about it. Has anyone any advice?

I think you could argue that this was not "in a public place" as it was a show open only to parents of the cast, i.e. a private showing. And I would let them know in writing that they will require your specific permission before publishing any future photos of your daughter, be it on the internet or in a local papaer.

It is not the photographer who needs to be in a public place, but the one being photographed. So, no, someone could not take a photo of your child in her bedroom and publish it, because your child would not be in a public place, even if she could be viewed from a public place, IYSWIM!

Sorry CKC, this as open forum, you can't tell me things like DON'T YOU DARE.... sorry if we disagree on that, I may not know the law but I may have more experience about this subject than you! I won't post replies to your subjects in the future.

Photos of dd removed and in group photo her face pixelated out. Also individual photos and names removed of all children.
