Staff smoking at nursery

Is it OK for a member of staff in a pre-school to smoke. This member of staff only works 3 hours in the morning so she sneaks out the back when the children are outside once she's done the clearing up.

Technically she's not on a break, but isn't working with the children and has done her other stuff so there's no requirement for her to be doing anything else at that time IYSWIM.

Is this OK?

I don't know, depends on what aspect you're asking from. If you run the nursery and would rather she didn't go out for a cigarette break at that time then tell her so, if you are ok with it then it is ok.

Unless she is smoking around the children (which she isn't by the sounds of it) then I can't see a problem.

Other people use the venue for an exercise class at the same time and have commented that they can smell it. I go to that class and I know the nursery smoker is quite well.

It doesn't look very good, I suppose.

That must be really annoying being able to smell it.

If she is outside and not smoking in a non-smoking area I don't think you can say much unless you're a good friend and can say something along the lines of "Fag ash lil, how about you move round the corner? It STINKS!"

some workplaces have a sort of exclusion zone' in which you can't smoke to stop the smoke drifting back into the building and also giving time for the smoke to disappear from the person themselves iyswim. It wouldn't look good to me tbh.
