How to get Nursery deposit refund

My lil boy (3yo) who doesnt live in the UK for various circumstances is visiting me for 3 months. I work full time but need at least 2 days a week childcare so I enrolled him in a private nursery. We did 3 settling sessions 45 mins long for 2 days and he cried all 45 mins. I have paid 310 pounds non refundable deposit and admin fee and the contract is for 3 months only. Now the nursery say that they cant take him in as he cries and wouldnt settle. They also mentioned he beat others which I dont believe at all as hes the sweetest child never has beaten anybody ever. The caretaker mentioned that he pushes people when they try to consoling him and I think its perfectly normal for a 3yo. So they are cancelling the spot. They know that I am on a visa as I mentioned it to them on why Im not utilising the free funded spot. Now since they are the ones cancelling the spot can I get a refund on the fees that I have paid? How should I approach it as it was mentioned that its a non refundable deposit

Do you have a contract with them? If so, what does it mention about the deposit? I would have thought that if they are cancelling the contract, the deposit would be refundable, but it all depends on the wording in the contract. I covered Contract law last year in my law degree and it sounds like a breach of contract but it does depend on what that states.
