Nursery cancelled our place

Need some advice!
I found a nursery for my two year old and viewed it in may. I originally asked for 3 full days and then changed it to 5 full days ( which they confirmed) before I paid the deposit of £300 which they said is non refundable. I am still yet to pay the advanced payment of £1638 which they said can be paid at the end of August for September 1st start.

Anyway they have just emailed me to say that I havnt confirmed the days and that my place is now lost. They said they can refund my deposit even though they originally said it was nonrefundable. Now I have less than a month to find a new nursery for 5 full days a week.
What are my rights regarding this? As I paid the deposit to secure her place and I don't think I'm going to find any nurseries in the same price range in less than a month. I really do want this nursery, what do I say to them?

Non refundable deposits are usually refunded if the setting doesn't have a space, they are not refunded if the parents just decide they no longer want the place. You may think it is a good nursery but it doesn't sound it by the way the management is behaving.

So I just received a call from the manager who said they have made a mistake. Luckily they have a spot but only until December where I would have to change nurseries. When I said sue I meant report to the ombudsman which is a free service. But yea thanks for the tips everyone ❤️
What are you going to do?

She is meant to be starting in 4 weeks so I'm going to take it, too much hassle to find another one xx

It sounds to me like they've over booked to Be honest which isn't great with so little notice.
I'd contact them and ask them what they can do and go on a waiting list for the other 2/3 days whatever they're short

I'm guessing you aren't in uni 8-6 Monday- Friday most courses are barely 16 hrs so it might work out for you hopefully unless it's a course with tinned of placements but maybe check out some local childminders too as they are generally cheaper than nursery

Not sure tbh, maybe someone has already signed up for then!

The course is full time as it's a Russel group and I'm doing a stem subject 😩 we get Wednesday afternoon off but the nursery works out much cheaper with 5 full days. I think normal days are 64 a day but 5 full days discount is 54 a day which basically works out the same.

And yess hopefully there's a cancellation, she said they normally have people cancel over Christmas is this true?x

This - they took your deposit and admitted they messed up. They need to find a solution.

Accept the "temp" place for now and follow up until they resolve.
