Nursery closing

Hi everyone !! I'm new in here . But I'm really struggling to find advice so I was hoping you all could help me . My baby was I a nursery since October always paid it on time . On the 29/8 the nursery has send a email to all parents saying it was closing down and they were giving us 2 weeks notice . I really need to know is right by law to do that? On the contract is saying that we need to give one month notice if I wanted to remove my baby . Doesn't it work both ways ? Please help 😊

I would imagine it depends on the reason for the closure. Sometimes they don't get much choice and have to close immediately.

I imagine they've gone bust. Notice means nothing in that case.

would it matter- if the nursery is closing it is ceasing to "trade". Would you expect compensation for the lack of notice?

How stressful! I assume if they’re shutting down for financial reasons then there may not be the money to stay open for a month. A local nursery went out of business recently, my advice is to ring around other places very, very quickly to avoid being really stuck. I hope it all works out.

If it is closing, there is not a huge amount you can do.

A few years ago a local nursery ceased trading the Friday before half term week. They did private day care as well as early-years sessions. They just sent out an email at midnight to say that they would not be opening the following week, or ever again. People couldn’t even go back to get their children’s spare clothes etc until the nursery had new owners a year later.

What about the fees ? Do I have to pay it ? Because they breach the contract . Thank you everyone for all your answers

If they gave two weeks notice on 29th of August then they’re already closed and you owe no more fees surely?

Do you pay fees in advance? I’d be reluctant to pay advsbce fees now.

I imagine you would literally pay for the days you use in the build up to closure? So half a months worth potentially? Just pay for the time that the nursery is open.
You won’t have to bother with any notice period yourself now so don’t worry about that.

Lack of notice for you will likely be lack of notice on their part too. I imagine most staff will have had little more notice than you - most likely financial problem which they just couldn’t climb out of.

If you had notice on the 29th August then the nursery is already closed? You just need to pay for the time your child was there if you haven't already.
