Hey I am in a position where I think me and my partner may be splitting up I am currently living with him and baby but we are renting a propert off his relative so he says it's not my house and I have to get out anyway i have some money saved if I did have to "get out" I am returning to work in a few months so baby will be in nursery full time. Can I force him to pay half of the nursery fees ? I know he should but legally can he get away without paying for them ?

No you can't. But you might be able to get some of the money from tax credits/ universal credit which ever one is in your area.

You will be able to get tax credits to help with your childcare fees

He will also have to pay you child maintenance. Google the calculator and it will give you a rough idea of your entitlement
