Day nursery issues

I'm new on here just after some advice,
My 3 year old daughter has attended day nursery full time since the age of one, they have always had issues with "biters" and I'm aware that young children do bite.
My concern is in a 3 month period my daughter was bitten 35 times always by the same child. I had exhausted all methods agreeing my daughter could be shadowed, letting her use the playground with the older children rather then her age group and to allowed her to eat with the older age group rather then her friends. I had no option but to remove her from the nursery setting as the bites were viscous and always broke and bruised the skin, they were also always on her face or back. My problem is now the nursery are insisting on the 4 weeks notice and threatening to take me to court, they are refusing to give me copies of the accident report forms and her day sheets, any advice would be much appriciated I have also took my complaint with Ofsted.

Can't help with legal aspect but why on earth was your child segregated when she was the victim? They should have informed biter's parents, done everything in their power to prevent it happening again and failing that, as a last resort, to ask the other child to leave.

Nursery worker here. 35 times in a month is too many. They should be shadowing the biter. That would stop most of it, but not all, but 35 times? Please report to ofsted. They have failed to keep your child safe. 4 weeks notice? fuck em. go to court. Tell the judge/magistrate about it and you'll win.

Tell them you will be taking legal advice regarding seeking compensation for your child's physical and psychological damage and you need the money for a lawyer.

Thankyou for your replies it's not that I'm not willing to pay I just believe they never delivered the service I payed for, I think I will go down the court road as I wouldn't want another child to go through what my daughter has gone through. Maybe I was just too nice and understanding with them.

Just tell the nursery you are not paying the notice period as they have failed to safeguard your child

I see that you have informed ofsted. I hope they get an inspection and get hauled over the coals

I monitor all accident and incident forms and would have measures in place after the first bite.

You probably don't have much sympathy for the other child, but the nursery have failed this child too. I can't imagine what the environment must be like when a child is able to bite another child 35 times. Something is seriously wrong there.

I know who the other child is, this is totally out of character to him and yes I really did feel for him. The problem was he loved my daughter too much and became jealous very easily. I felt for him too as if she was being bitten that many times how much was that little boy being shouted at and put on time out. The issue was never really the biter as to how much they were being monitored and if they knew there was a issue why did they allow it to continue.
