Notice period required for nursery

I gave one month's notice to my child's nursery on 11 August and asked that the last date she attends nursery would be 12 September. The contract states that I need to give one full calendar month's notice. The nursery is now stating that I need to pay till 30 September and not till 12 September. We basically disagree on the definition of 'full calendar month notice'. My interpretation is 30 days while the nursery interprets it as the end of next month (unless you give notice on the 1st of the month). My argument with them is that the term 'full calendar month' is ambiguous as it can mean both things and had we known it meant this we would have given notice on the 1 August.

Can anyone advise?

A calender month finishes at the end of the month

I am with you, a month's notice should be enough for them to fill the place.

Yep, the legal definition of a "full calendar month" is from the 1st to the end of that month.

You have to pay up to the end of September

If it's in the contract queen it's not about "should be".

Under the contract she has to pay until the end of September.

Frisson there is no problem doing that if the contract states "one months notice". Then you can give notice whenever to leave a month from that date.

"One calendar months notice" has a slightly different meaning.

I agree with you. I would have thought it would be 30/31 days from when you have notice.

I would pop into citizens advice with contract for advice.

It really couldn't be simpler.

"Calendar month" has a very simple legal definition. Google it.

I got legal advice on this and I was told that I am right that calendar month does not imply end of the month. I also spoke to the nursery who were brilliant and agreed to accept 30 days.

@plinth if you google it you will find that both definitions are used. My point is that it is ambiguous enough to create a misunderstanding. I'm glad that the nursery also agreed with me without making any big deal. Great nursery
