I am looking for advice please
I am a father of 2, my son lives with my mother now as i only have a one bed flat and my son aged 14 and his mother kept arguing as of oct this year 2018
I get my daughter aged 10 every second weekend and holidays over 52 days per year,
I have always paid the agreed amount through the csa and now cms
My ex however has decided out of spite to tell the cms i no longer get my children at all, so my payments have jumped up, the cms are not intrested she is defrauding me, them by giving false info.
The cms say i have to prove i get them through a court order as she has said there is no shared care despite one child not living with her and other over every 2nd wknd
However surly my ex has to be liable for child tax child benifit and maintenance fraud as she is claiming more money off me she is not entitled to
I have one wage to pay all bills plus maintenance with no benifits.
The fact i can prove i get my children via photos and txts should go in my favour
Im thinking of going to the police and mp about it as i am having money stolen off me technically and have proof
Why should my vindictive devious ex be allowed to defraud and the cms allow it to happen with no care at all as long as my children are recieving payments, must note that i spend on my children the best i can when there in my care but the amount being taken illegally now is putting strain on my everyday life
I dont know how much my ex would recieve
However i guess with her claiming housing council tax child tax child benifit working tax plus a 16hr a wk wage plus maintenance will be far financially better of than me so it feels wrong that i am being made to suffer whilst trying to do the best i can by my children i am basically only surviving as my monthly wage is less than £1000 mth to pay everything plus maintenance plus the overpayment which has now left me with next to nothing to live
Any advice or solutions
Do you think she should be allowed to get away with it?
