hiya we are currently in the middle of getting our house repossessed , which was our desicion and have found a private rented house that we are moving into in a month , Would we be able to claim housing benefit for this new house ?, we would qualify in normal circumstances , just wondering if the evoulantry part of the repossession would cause a problem for this

I think you're worried about "voluntary homelessness", where the council may (or, more likely may not) have a responsibility to house you. If you qualify for housing benefit, you qualify - you've found your own house so it shouldn't be a problem. (Assuming they'll pay for a house that size etc)

ditto what OldLadyKnows says

if you qualify because of you're income you qualify - and it doesn't actually matter on the house size. What happens is that your LHA (that's what it's officially called now) is a set amount for your circumstances.

So you may qualify for a 3 bedroom house this website is the one to check for your entitlement for bedrooms.

Your local LHA may be £140 a week for a 3 bedroom house. And if you financially qualify for LHA (HB) then you'd be given £140 a week - if you chose to get a 5 bedroom house then you'd still get your £140 a week - and you'd have to top up the extra. Likewise if your rent on your 3 bedroom is higher than the housing benefit (or LHA) then you'd have to top up the rent yourself.

You can find your local LHA rates on that website I linked to as well.
