Can someone just help me clarify something - tenancy agreements and rent.........

ok - so I moved into here on Feb 1st. Periodic tenancy agreement, but minimum occupancy of 6 months.

I want to leave (lovely house - but marital home with DH much nicer ).

I pay my rent (as most do) a month in advance. So I paid for Feb rent at the end of Jan.

My agreement says I have to give a months notice ending the day before rent is due. So in theory that's the 30th July my notice has to finish.

Now in theory I should stay here until the 30th of July - yes?

But don't have to pay rent at the end of July?

So if pay my rent at the end of June - move out, tell IS/HB/CT etc that I've moved and am now living as a couple and they then stop those things and we claim as a couple then I won't (in theory?) be breaking my tenancy agreement will I as - as I don't owe them any money at the end of July do I?

That sounds reasonable. Why not give the landlord notice that you want to quit at beginning of August now and then there will be no confusion over what is owed - or you will, at least, have a much longer time to sort it out.

Glad you are moving out for happy reasons.

That is correct. You need to give them notice at the end of June, and have moved out by the end of July.

Actually we had a tenancy agreement for 12 months and moved out 6 months early, just went back to check on the house every couple of weeks (and collect post) as it stated in our tenancy agreement and we were perfectly within the law to do that as we were still paying rent.

Most tenancy agreements will have a clause about not leaving the property empty for longer than three weeks so you might need to have a look at the contract.

yes it does say that, but I shall just pop back a couple of times a week until the end of July to collect post, open windows/keep fresh

We've set the date for us moving back in with him - last weekend in June.

oh yes it is .

We've been spending a few nights at his, then a few nights at mine, and then a night or two seperate since the start of May and DS's and I are moving back in with him at the end of June

And stuff the legal stuff - she'll have her money for July, but I'll be outta here (and we'll be scraping by on JSA together - ho-hum )
