matnerity leave, holding vacancy open etc, redundancy

If your work doesnt have to hold open your vacancy after 6 months, but offer you similar employment, do they have to tell you they are filling your old roll and that it will no longer be open to you on your return.

similarly, if you return to work and they have dissolved your old roll, do they technically hhave to other you redundancy rather than make you do another roll?

hope this makes sense.

No - you have made the choice not to return after 6 months.

No - if you return after more than 6 months you have the right to return to a suitable role on the same terms and conditions.

They can't 'make' you do anything, because you have the right to leave. What they cannot do is replace you with someone else and then tell you that your job has gone (and make you redundant)

I also wonder about the 6 month thing anyway - I'm sure there are ways around it. A job is unlikely to be identical even 6 months later.
