A few questions regarding parental rights please.

XP was very violent and ended up hurting our DS, i kicked him out and pressed charges but i have a few questions if i may...

I want to change DSs surname(to mine), i already tried to but got scammed online and didnt end up doing it.

I understand that i am allowed to in certain circumstances (like when the parent is violent) you can change names without the parents consent.

XP has said i can change DSs name, so i have his word but he could turn around and say that he didn't and from what i understand i can get in trouble for doing that???

Also i am really worried about if i die before DS is an adult, i want to make sure there is NO chance in hell that DS will go into XPs clutches.

And finally is there anyway i can have his parental rights taken away from him, i am not going to go into details about what he has done because thats not what i want to ask advice about but i would like to know, if i can how do i go about it??

Hi, I changed my DS surname who is nearly 3. On his birth certificate he had my surname and XP's so I changed it to just mine, I do not know where XP is and have no contact I changed it by deedpoll and had no problems. Their website it quite useful. The only thing I had a problem with was the passport, they said my son could change his name only at 16.

As for what would happen if you died, I did look into this and I was told that courts look at where the child has been raised, where they consider home and who they are used to living with. This is something that also concerns myself as my new XP has been with my DS since he was 11 months old and my DS has no memory of his biological parent. Therefore I would like to think my DS would stay where he considers his home to be.

As for parental rights were you married to your XP?

No, we were not married but his name was put on DSs birth certificate.
