I tried to take a pair of Maternity trousers back today as they are a horrendous fit on me. When I bought them - prior to their going totally tits up - I checked I'd still be able to return for a refund and they said I would.

Anyway, they now say I can only exchange. I tried on 3 pairs of trousers and they all look dire, but I've come away with a pair that would just about do.

I am very annoyed but don't suppose there is anything I can do is there. The things I could ahve bought, such as tops or bump bands were al size XXL!!!

It's down to the administrators. Please don't take it out on the shop staff.
The administrators are there to get as much cash for the creditors as possible, so will not give you money back (and legally they are within their rights to only offer exchange).

I didn't - the shop staff were very helpful and we jointly bemoaned the fact that BM may go under completely.

I bought the original trousers 6 days ago.

I thought they went under longer than a few days ago. No retailer is under any legal obligation to offer a refund or even an exchange if something doesn't fit. You could try to argue with manager that you had a verbal agreement but ultimately it might go against her and any sales related bonus for those in the store if she used her discretion to refund. Sorry.

they were definitley in trouble more than 6 days ago

i guess you were advised wrong 6 days ago but it doesnt seem fair that you specifically asked and they answered you wrong

They actually only went into administration a couple of days ago - they have been struggling for a while but filed for administration on weds/thurs - therefore, you weren't advised wrongly originally as the shop staff wouldn't have known (but probably could have guessed !). The administrators have no obligation to honour any such agreements unforetunately.
