had a crash today in car but i hit a man!

I was driving down a country lane, hit a bend and skidded across the road.........

Just before i did this there had been a crash where a woman coming in same direction as i had been had hit a mans car on the other side of the road, when i hit that bend they were stood in the road exchanging details, i turned into the skid and narrowly missed his car but in the process of turning to avoid his car the man was hit by my car.

Im confised as to exactly what happened. The lady who had had the first crash said i did not hit his car at all and all the damage to his car was her fault, the gentleman said apart from some scratches and a huge graze he was fine but i have asked him to go to docs and get checked. My car is damaged at the front and i cannot work out whats caused that damage, either its his car or its his body, either way im not sure what to do.

Have rang insurance company to inform them of the accident but i dont know what to expect. Am i liable for damages? Can he sue me for his injuries despite the fact he was the one who was in the road on a blind bend? He refused an ambulance and only agreed to get checked by doctor after my BIL asked him to for my benefit.

I gave both dirvers my name and address but both refused my insurance details stating i had not damaged the cars and he was ok.

Im so scared and shook up by this, it was horrendous to see an old man go over my bonnet and not be able to stop it. I was going at about 20MPH max.

firstly, poor you, it must have been a horrible experience. secondly, and this is going to sound terribly calous but if you want your insurance to cover the damage to your car they will probably pursue the gentleman for the costs as he was, from what you say, standing in the road. Whatever the scenario keep your insurers informed of all the details.

Bonkerz, no advice but glad you are OK and that the man is. Talk to your insurance company.

If you can go back and take some photos of teh blind bend so you can attach them to the claim form.

Do you also have the lady's details as she could be a good witness for you - saw you not hit his car, saw that he was OK etc.

Why did you skid? Agree, with OneLieIn, go back and take a photo and have a look at the surface - if there's a problem, the council needs to know about it.

police were called from the roadside but didnt seem concerned or bothered. There was black ice on the bend which had caused both skids. I dont have her details at all, i gave her my card so she has mine, he also has my details but both him and her were insistant i did not cause any damage.

I am glad you and the man are OK.

I have to say that I think if you hit something else in the road it is probably your fault, whether on a blind corner or not - as there is always the possibility that there will be a pedestrian or a cyclist or some animals or a tractor or anything. So unfortunately it is up to you not to hit things in your path.

However as you skidded and there had already been a crash it sounds like there was something dodgy about that part of the road - have you let the police know to avoid anyone else crashing there as well?

If I were you I would just tell the insurance co exactly what happened, give them the details of the man and the woman and let them sort it out. As you are insured you will be OK.

we are fully comp, have rang the insuarnance company. I didnt get the man or the womans details as they said they were both fine and he insisted i hadnt hit his car. At the time i was so shook up myself i just made sure everything was ok and left them my name and address., the reason i hit him was he was in road inspecting the damage to his car, i missed his car as i managed to correct the skid but he had moved into the road to get out of the way instead of moving behind the car like the woman did. I totally accept i hit him.

well i dont know if it has got worse or better.
Our insurance company are fine, they are going to fix our car no problems.
The man has just rang and said he is fine, got bruising and is sore but is fine. He said the lady doesnt wwant to persue through insurance and will pay to get all of the damage to his car fixed. He says after looking at his car he thinks i did scrape the back of his car but that the woman does not want him to claim on my insurance for this damage and will instead pay to get all the damage fixed. I said i would get my insurance to sort the damage i had done BUT apparently this would mean the woman would need to go through her insurance also and she says she doesnt want to......does this sound dodgy to you~? im now wondering if the woman has insurance at all!

the only reason to choose not to go through insurance IMO is if you dont have any

have you told your insurance company?

as the man has 2 years to claim from your insurance compensattion for any injuries he incureed as a result of being hit by you...

ok he was in the road, but that does not give you the right to hit him (nit suggesting you thought younhad a right to hit him or you hit him on purpose etc [smile[), but you hit him and if he schhoses to claim compenstaion for his injuries / psychological damage etc then he can

also bodies can daage cars a lot

i was a pedestrain hit by a car (that didnt hit any other objects) and i wrote the car off... their were bits of car everywhere and the metal bumper looked like it had hit a solid post hard... it waqs my leg that did that!

i also dented gthe bonnet, and smashed right through the windscreen with my head

Bonkerz...you need to report the incident to the police firstly.....as someone was hit and posssibly injured....It will hurt him tomorrow even if it didnt hurt him at the time.

apart from that you have notified you insurance .....as well as the photo..do them a little sketch of where everyone was and where the vehicles were parked.....

did you get his registration...if you did your insurance should be able to trace him and if he damaged your car they can pursue that if you need them to.

and lastly (easy for me to say) do not worry....nobody was seriously hurt, luckily you were driving at a sensible speed and was able to avoid more damage. XXX

Bonkerz you have done exactly the right thing.

You have been honest with everyone and the insurance and so that is fine.

If the man doesn't want to claim for damages to his car as the woman is paying, then obviously that is his lookout. You have told your insurance so if he comes along later and claims there won't be any questions and the insurance companies can decide who, if anyone, was at fault at that time.

I do think you should ring the police though. There could be some oil or something on the road which could make it dangerous for other people, and like stoppinattwo says there was an accident involving a two cars and a pedestrian and so really you should tell them. That way you have covered yourself if anything comes back later (I'm sure it won't).

Please try not to worry. Would be a good idea to get the bloke's details if he calls again though.
