need advice and quick as i am worried sick

Ok we rent privatly and are on HB but due to come off now dp has started work. Anyway for some reason even though my tenancy states my address the HB were paying for the upstairs flat which meantthey ended up suspending the claim and have reinstated it now they have sorted it out.

Anyway I emailed and phoned landlord to explain what had happened he already knew as he had been dealing with council tax peeps about address. Anyway he tells me he has no sympathy and he is putting the rent up which means I am going to be fucked anyway. He has also said he is not sure he wants to carry on as this is the second time it has happened. I explained that there was nothing i could do and he is telling me he wants half of the rent tomorrow and doesnt' care how i get it, the rent is £1040 when he puts it up it will be £1200.

Now don't get me wrong it is a lovely flat BUT the ensuite wall is caving in (he said "oh thats what happened in your bedroom too") DS1's bedroom is damp smelling because of 2 leaks which were from upstairs, 1 was on the day we moved in and he had to cut away parts of the ceiling to find where the leak was, that was August 19th and he still has not repaired it! the hallway has a damp patch on the wall, the floor is sinking, you can feel it as you walk, and there are cracks appearing every other wall.

Now i spoke to the council housing dept and they have said that if he does that and I cannot afford the rent then i must hang it out until he serves me with notice to quit and then applies to court for us to be evicted. I feel really shitty about this as it will mean leaving the home i have only been in 6 month and uprooting the kids again...

what would you do?

have you a contract? Can he just put the rent up like that? TBH, if it were me I would think about moving, no idea if that is an option.

I think you have to move on. That property sounds dreadful, and no place to be raising little ones.

Lady we have the tenancy, it states on there that if the rent is on time it will be at the reduced rate but if it is late there will be charges.

If you did get evicted will the council house you?
I would look into that as a council tenancy will be far more secure than private renting.
I know it's a crap situation but it may turn out for the best in the long run.

The landlord can raise the rent as long as he gives notice. I think it is 2 months but should state this in your tenancy agreement.

You can go down the route of with holdng rent until repairs are made etc but tbh it sounds like you are much better off moving out. The landlord just sounds rubbish.

I know you don't want to uproot your kids but the flat you are in is simply not suitable nor is it a secure long term home.

Idrank he has the tenancy as a 6 month tenancy with review after this time. It is due for review today..i guess he won't be renewing it! anyway I have spoken to the council and they have said he has to serve notice on us before they will rehouse us.

I think everyone is right that it is time to move, and hopefully the council will rehouse us and then we can stay put. Prob is they will rehouse us quicker if i were a single parent ffs otherwise they will offer us shared ownership. which tbh is not what we want.
