We have signed a contract with an estate agent (few days ago) but VERY unhappy with service. Can we get out of it?

HELP! I'm so angry. We went with this agent because they seemed the most straightforward of the bunch. It turns out their website is shite and on doing a little research the web coverage of our property is none-existant. Can I do anything? It's my own fault I know, I should have checked beforehand. Could KICK myself.

There should be a cancellation period in the contract. Ours was one week with our EA. There may be a few terms and conditions. Check your contract and give notice asap and get things in motion with a better agent.

Check the contract. It should state what they will do to market your property. If they are failing to market it in accordance with your agreement, you should write to them giving them seven days to comply with the terms and conditions, failing which you will consider them to have breached the contract. This will entitle you to cancel the contract.

Thanks. Am going to look now and see if there is a cancellation period.

You are usually bound for 8 weeks minimum, then you're allowed to terminate their contract.

Actually, their website may be shite but what's more important is that they advertise your properties on webstes like rightmove, hotpropeties, etc. Have you checked to see if your agency has presence on these property websites? Nobody really ever look up individual agencies' website these days.

schwotz · 02/10/2008 14:44

If they are not offering the service promised, I would point that out to them as Freckle said.

I have checked contract. No mention of cancellation. They are on rightmove but none of the other ones. Feel like an idiot for not checking before we engaged them. Grrr.
