2 child cap exceptions backdated??

Aquariusbaby84 · 01/10/2024 14:58

Hi I wasn't away of the excemption circumstances for children born under the 2 child cap. I was made away by my GP recently while being treated for recovery from my DV marriage. She's filled in the relevant forms to apply for the cap to be lifted off my daughter who was born under those circumstances. I'm just wondering if anyone has had any experience with this type of claim as my daughter is now 7 years old.
I am aware there's no limit on time scale to apply and I should be awarded the exception rule for her ,has anyone has this backdated ? And for how long was the backdate? Many thanks in advance

@Carol4155 @Carol41556 @Aquariusbaby84 @BeWildMauveHedgehog @Rachael222722 did any of you go to tribunal and were you successful if so?

Unexpectedlysinglemum · 27/10/2025 23:08

I’ve read that they don’t backdate ‘as you have access to the same info as everyone else’

I have today been refused back date payment due to being out of the 13 months time frame. I have requested an MR. Anything else I can do or say to the to get it backdated?

Hi did anyone manage to get the child element backdated? I've just been declined today due to the 13 month late reporting. Do I now request an MR??

Boymum27B · 22/04/2026 20:19

No back payment here either. I have been fighting since October. And looks unlikely. I have contacted tribunal to see where I stand also.

Starburstzco · 22/04/2026 21:20

How can they backdate for some and not for others? This is wild to me

Starburstzco · 23/04/2026 13:00

Mine has now gone for an MR so praying for a positive outcome

Boymum27B · 23/04/2026 17:30

Good luck keep us updated.

Can I ask
how long your MR took? As on my
journal they've put they will decide within 3 days! I didn't expect them to be moving that quickly

Boymum27B · 23/04/2026 23:01

Well… first one was about 3 weeks second one was 3 days as I was on their case- fingers crossed you get the answer you deserve

Starburstzco · 24/04/2026 16:03

Hey lovely, they approved my backdate.

Boymum27B · 24/04/2026 19:25

hey how long have you had it backdated? Over the 13 months?

Starburstzco · 24/04/2026 20:25

yes over the 13 months. They rejected it for being over 13 months and then I asked for the mr and they backdated it

Boymum27B · 25/04/2026 07:50

Can I ask how much over the 13 months? I’ve done all of this and not got anywhere so appreciate the advice. Thankyou

Starburstzco · 25/04/2026 11:28

18 months my sons a year and a half. What reasoning did you give for reporting late?

Boymum27B · 25/04/2026 14:36

I said that due to the circumstances and not knowing and my mental health I wasn’t able to report. Really pleased for you x

Starburstzco · 25/04/2026 14:41

I wrote a long letter in my journal & I also highlighted that on an occasion last year in June - I spoke to my case manager about additional support with childcare - luckily the case manager had wrote something in my journal - and then a week later I went into the job centre (because I'd just got a new job) and I said that I mentioned what my case manager had spoken to me about but that the lady at the jobcentre didn't have a clue what I was talking about. So honestly I think that is what tipped it in my favour. The fact there was something in the journal about additional support.

Starburstzco · 25/04/2026 14:41

How far over the 13 months are you?
