15 hours free childcare (dla) and 100k threshold

Hi there

does anyone know if I would be eligible for 15 hours free childcare if my son is in receipt of dla, but I earn over 100k? The hmrc website seems to say two different things

Eligibility is based on your net adjusted income, here are some links as there’s not enough info in your post to say.

just in case someone in future is looking for the same info: the 15 free hours scheme for kids with dla is not affected by earning over 100k. It is dealt with separately by your local authority. Hmrc don’t always give correct advice on this.

We are just starting the process of applying for free hours and our daughter has just been awarded DLA. I stumbled across this post but now we are being given very different information on the 100k limit!
HMRC have said they have no idea and the LA have said we would stop being eligible.
Could you give me any more information or help on how you got them to agree to fund 15 hrs when earning over 100k?
They have said theres is a separate DAF payment that wouldnt be impacted, but that goes straight to the nursery and doesnt impact what we pay.

im not sure if it’s at the discretion of your LA, but ours said it was a separate pot and so although hmrc said we wouldn’t be funded they said we would. I can’t see how it would be down to your LA. Maybe you should ring again and see who you can talk to? You could also phone a charity to clarify?

im in this situation - my 2 year old son gets HRC and has conplex medical needs and is in nursery. Tried to get a code online from gov.uk to give to nursery and days we aren’t eligible. But the local authority are saying we need it so I’m going round in circles! We’ve also been told our inclusion funding for my son is dependent on his funded hours eligibility which doesn’t make sense to me!
