Child Benefit Advice - Who gets what?

Need advice. Ex husband claims child benefit for both of our kids. The child benefit office ruled in favour of him 3 years ago, as he had stopped me from seeing the kids and they would not wait for us to have our final hearing at court around the children.

Child 1 we share 50/50 (age 11) and Child 2 lives with me 40/60 (50/50 in holidays) age 15. Ex earns c. 90k and is now cohabiting with a Judge who must earn well over that. I earn 37k. I suspect he has not told CB this and I have evidence he has a joint bank account with new partner as well.

He refuses to transfer any of the benefit to me, as despite having to pay it all back, he can keep threatening me with child maintenance payments to him, whereas if he loses the child benefit he will not have this leverage.

I have been writing to CB office lots and no reply, but is it worth me trying to get it transferred to me? In my opinion they seem not to care, but it does not seem right that he is nominally claiming it, whereas to me it would make a big difference.

Any advice would be much appreciated.
