Can my bank refuse to do a charge back?

on Thursdays I ordered a takeaway but received someone else’s order, I complained to the company (just eat) and sent pictures and asked to be refunded to my bank account because I wasn’t going to order again, they responded the next day telling me they had credited my just eat account and won’t refund me, I contacted the bank who said they would do a charge back but I had to wait till the payment had left, well today I called the bank and they have refused to do a charge back! And said because I have been given credit they won’t refund me. Can they do this? As they told me last week they would do a charge back.

It's the bank's discretion whether they'll do a charge back, if you've received credit in your account then you've already been put right for the mistake

You can't be refunded twice for same thing!

SpinningFloppa · 16/01/2023 12:19

hmm ok I don’t understand why they told me last week that they would do it, very annoying

Seems like the bank think you have been refunded even though it's credit to your just eat account. They won't do a charge back if you have the credit back already.

Maybe contact just eat again?

I’ve not been refunded I was given a credit note a day later which I asked not to as I won’t be using it! I asked to be refunded to my account I was sent someone else’s order I only ordered the take away because my online shop was messed up and wouldn’t be coming till the next day so if I get sent an entirely different order surely I’m entitled to my money back? I didn’t get a refund at the time it was the next day so I couldn’t reorder at the time

I’ve contacted them
loads of times they’ve point blanked refused, they even lied and said I asked for credit I had to send them the email proving that I didn’t

Did you pay on debit card or credit card? Different rules.

SpinningFloppa · 16/01/2023 12:34

Debit

Banks are not obliged to do a Chargeback, especially for a debit card, and especially if credit has been given, even though you didn't ask for the credit you could still use it and therefore benefit twice if they refunded. Credit Cards work under different rules but I'm unsure if £100 + needs to be spent to get a refund.

They did it in the end as I called back and spoke to someone else and changed the wording ever slightly, I said they “offered” me credit, as that’s what it was, an offer, I’ve chosen not to accept it.
