Do UC backdate child disability element?

Hi, I posted this in SEN but nobody has replied. Name changed as I'm sure I will get the answer in a few days and I post a lot on here about other stuff, I'm just stressed and want some peace of mind. I already claim UC and I have finally had my sons claim for DLA approved (applied when he was younger and it wasnt approved, told to wait until his birthday and school help to reapply) he gets the high care rate and the low mobility rate, this means we are eligible for the UC higher child disability element as well. I'm just wondering if anyone knows if this will be backdated to when the DLA claim was backdated to which is the 30th September, my UC assessment periods run from the 15th to the 14th of every month usually I get paid on the 21st. I have updated my circumstances so think it should be on there this month, I only received the letter confirming and backdated payment yesterday so I told them on the change of circumstances straight away and left a note on my journal, but I am wondering if a anyone knows if I will get the disability element for 30th Sep-15th Oct and then Oct and Nov periods backdated? I can obviously show them the letter or maybe they can speak to DLA to confirm it. I've had to buy a lot of things even more than usual in lockdown both resources and to replace broken items etc so the money would really help, I don't want to sound greedy but my son is entitled to it from then so I don't see why I shouldn't get it? I probably should have appealed the other decision but I had lots of things on at that time, I'm just glad theyve finally recognised his needs now as I can help him so much with the money. Thanks in advance

So glad I found this thread. I to have recently claimed for the disabled child element to be backdated, mine goes back a few years. I got a letter on the 15th saying the decision maker was allowing the change and it was from the date I provided. Its the exact same letter as previously posted further up. But since then I've heard nothing. I've had no recent journal entries, nothing else has been said. Does that letter mean I am getting the backpay They have agreed to that? I read through the thread and most people have been paid within days of there letter but I haven't and I haven't received anything else letter wise or journal entry wise either

Hi looney mum….if they have sent a letter saying they have accepted it on special circumstances I think mine said yes you will be awarded backdated money from that date …I received my letter then my backdated payment about week week and half after…you’ll most definitely get it backdated if it said so payment just isn’t as quick if you havnt had payment from around 2 weeks after letter I would pop a quick message in your journal…hope this helps xxx

Hello, I’ve been getting the carer element since the 04/08/21 but not the high disability addition. I’ve had a message on my journal today to say it’s been sent to the decision maker how long does it generally take to hear from them?

Mishelley72 · 25/01/2023 17:13

I am receiving DLA for my child and also carers allowance. I'm on UC with LCWRA as I'm disabled. I have just applied for severe disability for child element and wanting it backdating from 08/2021 as I didn't know this element existed. Also can I claim carers element as I'm claiming carers allowance and not sure if you can claim both or not?

You cannot claim LCWRA and carers element. The LCWRA is higher so you get that one.

Hi Kerriann it took mine around 2 weeks to hear back from them hope this helps

Kerrianne25 · 26/01/2023 09:41

Thank you! 😊 hoping I don’t need to appeal and it’s just straight forward 🤦🏽‍♀️

Rebeccanew · 26/01/2023 13:17

No you won’t need to appeal Most are awarded they’ll send you a letter if awarded under special circumstances then a seperate letter how much they owe you xxxxz

Shelby1978 · 03/03/2023 05:15

Hi I'm having that exact issue. They've added the disability element but not paid the back date. I've had two letters through now from decision makers saying it is to be back dated.. And I've still not had anything from them. I've been going round in circles with them for three months n took four to get the actual element added. But yes they are most definately supposed to back date it and right back to the start date of your child's dla

Brownie0784 · 17/04/2023 23:13

Hi, can you please tell me how long it took for reply after notifying them

Sssswwww · 13/07/2023 15:30

Has anyone had disabled child elements backdated? I’m waiting for a decision to be made whether they’ll backdate or not and wondering how long it took for anyone else to receive

Rebeccanew · 13/07/2023 20:44

Hi ssswwww yes they do backdate child’s element they say it goes to a decision maker but it’s always backdated you’ll get a backdated payment soon and payments will go up hope this helps

Rebeccanew · 13/07/2023 20:45

Also Took around 2-3 weeks for mine x

Emma2345 · 15/07/2023 23:05

Hi just wondering if anyone can help me with this my son got accepted for dla last week HRC, this is a claim from the 15th of march had to wait almost 16 weeks for a decision I notified UC of the award which was the 13th July when I notified them as that’s when I got my decision,, my payment circumstances are from the 19th of one month to the 18 of the next I think,, will my child disability element be for example let’s say it’s march £400 April £400 may £400 june £400 in back pay so around £1600 back pay ? and then this month July the child disabled element should go on as normal with my statement and pay or do they not calculate the month you receive the award it’s a bit complicated for me coz I no when I first started claiming uc I didn’t get a payment for around 5 weeks so I’m just wondering if they calculate the payment for the month you was awarded the dla or if they go from April ? Thanks any advice would be really helpful

Rebeccanew · 16/07/2023 12:31

They will pay you right back from the date of the award you’ll be entitled to it all back dated it does say it goes to a decision maker but it’s always backdated so youlll be paid from 13th march when you put your claim in x

Emma2345 · 16/07/2023 13:15

@Rebeccanew oh ok Thankyou for replying

Rebeccanew · 16/07/2023 14:00

It may take 3weeks or so but you’ll get it backdated most definitely ☺️

Rebeccanew · 16/07/2023 14:01

Also rates have gone up so you’ll get a more than expected I would expect more than 1600☺️

Emma2345 · 16/07/2023 16:07

@Rebeccanew yeah Thankyou I no was just an example but Thankyou for letting me no I think it’s now £456.89 so that’ll be like £1827.56 from march to June or £2284.49 from march to July if they don’t put it on my statement this month then hopefully that’s what they will owe me x

Rebeccanew · 16/07/2023 17:31

Yep sounds about right 2k figure I’d say…be little bit more handy now school holidays have landed…hope you get sorted soon xxxx

Emma2345 · 16/07/2023 21:37

@Rebeccanew thanktiy and yes I thought around £2000 or a little bit more & yes will definitely help with school holidays and uniforms

Rebeccanew · 16/07/2023 22:45

Hopefully not a long wait have a lovely 6 weeks holidays hun x

Emma2345 · 17/07/2023 12:37

@Rebeccanew Thankyou hun yeah hopefully not I received a letter on my journal today to say they’ve accepted special circumstances to the delayed change of circumstance but still nothing about back pay or how much they owe me ive messaged 2 times & rang and still no reply 😂 so unsure when I will find out or when it’ll be back dated they clearly don’t like to rush on the other hand if it was me oweing then I’m sure they would be harassing me for it 😂 xx

Rebeccanew · 17/07/2023 13:27

You know what my money was in my bank before I even had the letter saying how much and when it was going in if you’ve had letter saying they have accepted it just keep Checkint your bank mine was around 3-5 days after I had the letter saying they accepted it….you get 2 letters one saying accepted then another letter saying the amount and when etc.. I’d say you’ll have it by the end this week start of next :)

Mammma91 · 12/03/2024 18:28

I’m just wondering if anyone has any update on how long it takes for the backdated payment to go in after a letter of special circumstance was issued? I had the letter on my journal today but no other letter about how much or a date.
