Offer on house and ex wont accept it

Hi, I'm currently in the process of selling the house as i have split from my ex husband. We have received an offer from a cash buyer who is going to be renting the property anyway and as part of his offer he would like to rent the house out to myself and children. However my ex has refused by saying he wouldn't feel comfortable me still living there. He knows that our son is worried about where we are going to live when the house is sold (i have two children, my son is the youngest at 12) and he is doing this to spite me. Can my ex legally do this?

If he’s frustrating the sale then you can apply for a court order which removes his requirement to consent to the sale. It’s a lengthy process to get there, though. Can you and the buyer hold off on the tenancy agreement until sale contracts have been exchanged, at which point your ex has no say in it?
