Child Maintenance Payments whilst Furloughed - CMS Facts Please

So I've been furloughed and my ex partner text me yesterday (3 days after the date they're meant to transfer maintenance for our ds) to say that they've not been working for the last 3 weeks, therefore has contacted the CMS and is waiting for them to advise of the new amount to send. This could take weeks.

I use the payment made obviously for our ds's needs... clothing, food (more so now as off school and eating me out of house and home!) but also towards my rent which was due yesterday. I am now short to pay my rent.

Are the ex's supposed to pay the amount as per the annual review until told otherwise by CMS?

My ex partner said they were going to the bank and until they,ve heard back from the CMS they'll send me half. I have asked them to send whatever they can, but are they in fact meant to still pay me the same amount as per the agreement, as if so this is what I want to go back and say to him.

I have dug out my annual review and it says to continue with payments as per the agreement but to contact them if circumstances change (both parents).

As he contacted me yesterday (Good Fri, Bank Hol) I am planning to contact the CMS too on Tuesday as I only work part-time and am being 80% of 3 days so my circumstances have changed too. If my ex partner is in the same boat they'll be being paid 80% of 5 days as full time.

I appreciate this situation is out of everyone's control, but I would have appreciated being told of their circumstances earlier and not after the date the payment was due. That was completely unhelpful.

Hope someone can help by advising.

I've responded on the other post however if he is furloughed the same amount of maintenance should apply. It's only of income falls by 25 to 30 percent that payments will be recalculated. That was a message on my CMS online

Hi @SpideyMom I've just responded to you on the other thread - Thank you.

I don't want to confuse matters by having 2 threads going but from what you read on your CMS online about furloughed workers still paying the same amount... do they stipulate the paying parent must make the same payment until they (the CMS) have re-calculated it as opposed to the paying parent taking matters into their own hands and telling the receiving parent how it is? Sorry, just wondering

I've started a new thread regarding the CMS and Furloughing.

After watching Martin Lewis last night a car salesman rang in and was told he should be paid he 'usual' wage therefore including his average commission amount. Interesting... and Googled it too... very interesting and now even more unsure what to believe!
