Paternity leave **move to a more relevant forum**

Hi

Just looking into paternity leave and pay for my partner from his employer, I have checked on the gov.uk website and it says he needs to of been employed continuously for 26 weeks to receive this but unfortunately he has just changed jobs and will of been there for maybe 20 weeks maximum by the time the baby is born maybe a 22 if I go over 14 days.

Obviously he will need to ask his employer, but does anyone know if the pay and leave or just the leave can be at the companies discretion as it does not mention this on the gov.uk website just says continuous employment and that’s it.

I’m not sure on how these things work especially for men and/or how the company would recoup the costs from the government for lost wages (if they do) or how they would authorise the time off.

I know where I stand with mine at least but now a tad worried about him not been able to spend the first week with me 😞

Hi he can take leave but he won’t be eligible for statutory paternity pay. SPP goes on the due date not the date of birth. His employer may offer enhanced paternity pay (many do) and there may be different eligibility for this. He could take holiday rather than not be paid/not take the time off, although I appreciate this isn’t a great option.

He could take annual leave or unpaid leave if his employer agrees. Best to speak to his employer

He isn't entitled to paternity leave or pay as both require 26 weeks employment by the 25th week of pregnancy
