Legal rights claim for ds - benefits

After reading another thread it got me wondering what will happen to my benefits if ds receives any money from his deceased father's estate.

I don't know how much he would be likely to get. The solicitor said there would probably be money from a pension or pensions. Would the money be put in trust until ds is an adult? What usually happens in these cases?

Yes money would usually be out in Trust if left directly to the child. I think sometimes a parent can apply to use some of the funds if for child - that would depend on the terms of the will/trust. I can't imagine it could affect your benefits as the money has been left to your child and not you.

if your child is receiving an income - as he probably will if there is a pension - of course that will affect any benefit payments you receive for him. If there is a lump sum held in trust for him that is a more complicated issue. I would ask the CAB, if you still have one, for advice.
