Can I be given a parking fine when there were no signs?

I was looking for a parking space on the weekend and drove through the private car park I have a permit for and at the very far end were some more spaces behind a low wall. I went through the large gap in the wall and parked.
When I came back half an hour later I had an £85 ticket for parking in an unauthorised space as it was residents parking!
I searched for signs and there was one on the outside of an entrance at the other end of the resident's parking, in front of a tree, A4 size, 8 foot up and pointing outwards so I could never have seen it from my car. There was no other sign (and I searched!) and I didn't use this exit with the car or on foot.
Can they enforce this even though there was nothing to show me it was private parking?

No, they shouldn't be able to. Write and contest the fine. If it's local authority you will have to go to the parking adjudicator. Take photos of where you parked and where the signs are. If it's private, it's up to them to take you to court but they will have to show evidence that you were given fair warning.

Thanks for that, it was private parking on the end of a council car park and I took loads of pics afterwards as I was so shocked that they could charge me that much with no signs.
The old blokey who put the ticket on came out to tell me it was perfectly legal and gloat which didn't please me much!

Sorry, it's a private pass only car park only for people who use a specific council facility that it is tacked onto the end of...

If it's private parking then the fine is totally unenforcable. Have a look here www.consumeractiongroup.co.uk/forum/parking-traffic-wardens/65341-private-parking-companies-charges.html

Wordgirl is absolutely spot on. Tell them to feck off.

wordgirl · 05/06/2007 21:08

You're welcome - just promise me you won't pay them a penny

Chirpygirl · 05/06/2007 21:16

Hah! I couldn't pay them if I wanted to! (which I don't)

What's really annoying is I have been parking in the other car park there for years and never go on a weekend as I know it will be a nightmare, but I had to go down and drop something off to MIL....grrrr....!

Ah, I see tortured at both ends of the journey! That happens a lot.
