Hi all, my mum just recieved a letter stating i have to pay £1900 before May the 4th. It was dated the 20th of April and it only bloody came through the door on the 5th of May at 10:30am and it's a bank holiday! I'm scared the bailiff's will come over soon and i don't even live there. I can just about pay it but i'm wondering if they can reduce it if i pay in full? I should of payed it year's ago! And now the debt has risen.

Thankyou

Usually the first thing that happens in a process like this is that you get a notice stating that a creditor has made a claim against you for X amount of money. At this point you either defend the claim or admit liability, and if you admit liability you can ask the court to look at your outgoings and decide what you can afford to pay.

You would have had to not respond to the above to get this far. What was the debt for? Have you moved house recently?

I would suggest you post on Consumer Forums - they have a lot of legal experts there. This must be very stressful for you :(

I'm just pissed i recieved the letter 2 weeks after it is was dated. I should of paid by the 4th and i got the letter on the 5th of May. I would of paid in full as soon as i got the letter. I hope they don't add fees for late payment! It's not my fault

Forget about the past for the moment - the important thing is do you have the money to pay the debt now or will it take some time to have enough money to pay them?

Ring the court first thing Tuesday morning and try and see what’s happened before you panic, good luck and inbox me my partner is going through the same.

Hi, I can pay in full first thing Tuesday when they open. I just hope they don't add fees for late payment! Not my fault

If you pay on Tuesday you'll probably be fine. Ring the court and the people you owe money too if possible on Tuesday to let them know that you've only just received the CCJ but are paying it now.

They'll add money on if they have to send bailiffs but that would take some time to organise. The bailiffs wouldn't be coming as soon as Monday or Tuesday.

Having said that, the only thing I'm not sure about is whether this will get entered on your credit record. What is the date of the judgment? If you pay within 30 days it won't get entered on your credit record.

HowRyou · 05/05/2018 21:23

I'm not sure...the letter heading says "Notice of issue of warrant of control" and its dated the 20th of April. Took 2 weeks to arrive.

If it's dated 20th April it sounds like it should be fine. That would make sense as the judgments I've seen have all said payment is required within 14 days. They get out on your credit record if they are not paid within 30 days.

So still phone the court on Tuesday and ask them to note on their records that you have only just received the CCJ and didn't receive the claim form but you are going to pay it that day. Then do the same with whoever you owe the money too.

Don't get too stressed. It will be OK.

Saz1995 · 06/05/2018 06:04

Just pay on Tuesday then it will be okay :)

HundredMilesAnHour · 08/05/2018 16:14

So how did you get on OP? Have you been able to sort it out today?

HowRyou · 08/05/2018 18:27

Hi, I paid the full amount! So much money. Still don't know why i didn't recieve a claim form or a judgement. I bet they made a good profit. Buying debt is a good business

Ffs!!! The OP is asking for advice, not asking to be judged and reprimanded!!!

The courts will try to be as helpful as possible OP. Good luck
