Party Wall Act 1996..we have had notices served on us after we made a kerfuffle

...and they have also served them on 4 other properties

it is a development which has had a new planning application put in at the same time as they served the notices

we are not happy that we had to force them into serving notices as they were tryin to bypass the legislation

we are not happy that they have served the notices from a surveyor whom they had not told the plans were only just going in

we are not happy that he will be truly independent and if he is we would actually like to have the coinfidence of having a second surveyor appointed by ourselves

now the question

if we choose to appoint a second surveyor will the developers have to pay for him/her

Yes they have to pay your surveyor and you can choose them

ah right

I have just spent the last 4 days writing a report for the council and have the photographs ot submit tomorrow

we have been in this process for 7 years

and planning permission was granted in dec 2002

but the property has now been sold and they have put in yet another plan which is even worse than the granted one (which also showed inaccurate measurements)

it has been such a traumatic process that we are keen to see it doen to produce as little further stress as ;ossible

is it quite normal for a second surveyor to be appointed by neighbours

If they disagree with the work proposed then yes. If you are happy with the propsed work then you just given written permission for it to go ahead I think.

But at anytime you can get a surveyor to work on your behalf and they have to pay for it. Can you tell I have had party wall issues before???
