Advice needed - can they just take the money????

Shortened version of story

Had new fireplace fitted. We paid half to order it. Half to pay pay when finihsed.

New firepalce fitted but some issues with it - basically it needs repair due to installers not doing something right.

Had invoice yesterday - the firplace place have taken the balance off of our credit card

My issues are

  • it isn't finished yet
  • it has had to be repaired so surely we should get a discount...

Have we got any recourse for this. All I want is the firepace I ordered! Sigh why are things never easy!

I'm pretty sure that if you phone your card co. up & explain, they'll cancel the last transaction until the dispute has been sorted out.
I'd get on the phone straight away if I were you.

Also, write to the company disputing their right to take the money as they have not completed the job in accordance with the contract. If they are not prepared to refund what they have taken or sort out the fireplace to your satisfaction, tell them you will take proceedings for breach of contract and contact trading standards.

I left a message for the company at 9.20 this morning and they still haven't got back to me!

So phoning trading standards and credit card co firts before I call them up again.

Sigh - I just want something to be staright forward!

Well have spoken to consumer advice people anbd then the fireplace man.

He is going to send someone around later to repair! If not I have lots of ammunition to put in a letter to him! Apparently I can also dispute th epayment with the credit card - there is some useful that helps with that too.
