Childcare and tax credits

Quick question for you wise mumsnetters...
I work 3 days a week, GPs look after DS on those days so no childcare costs there. But DS also goes to nursery on one of my days off (GPs not happy for him to go to nursery on the days I work as they are nervous about driving with him in the car, bless them, and I do shifts so couldn't do drop off/pick up on those days). Currently I don't claim childcare costs in my tax credits application, as his nursery day is my day off and I'm not sure if it is any kind of fraud/misdeclaration. My question is, should I claim them? And am interested to know if any of you claim for childcare used on your days off?
