if u take the curtain poles when u move out.....

and there are holes in the wall, are uobliged to fill them

yes it would be nice
BUT our ex owners did it and they did it with external cement
So I'd rather they hadn't tbh
it was in our contract that they would make good any holes left from furntiures and fittings being removed

Presumambly he has stated in the contract he's taking them in the first place?

I did, and painted over them. Having said that, the people we got our house from didn't bother.

In NZ you HAVE to leave anything that is fixed to the wall (ie curtain poles)
And generally you have leave your curtains too.

I would fill the holes if I were your BIL.

nearly3 yes he has stated that.
and he filled in some but the filler is white and the walls are coloured! so its a bit obvious, hes half done.

I wouldn't have thought there would be any grounds for complain unless the contract staes your bil will make good. I think filling and leaving is fine as it's possible the new people would want to redecorate anyway. Does he have some paint he can leave in the shed or garage in case they want to patch it up?

no he's not legally obliged to fill in the holes, the owners of this house took everything, including the blinds from the windows in the lounge, blinds that had been custom made for the lounge so would never fit anywhere else. We left everything, bathroom cabinets, toilet roll holders, towell rails ... curtain poles etc but seems this is not the norm so next time I move I'm taking everything.

My previous owners took everything including the toilet roll holders, curtain poles, bathroom cabinets and even the flooring in the conservatory. There are holes in every room - really left me desperate when I first moved in.

when I moved in the had taken the ligth fittings and left the wires hanging out of the wall! Charming (and illegal apparently).
Know they took the curtain poles but left the curtains neatly folded up on the floor so can't really remember if they'd "made good" the holes!
