my husband was beaten up - can we get compo?

well shit kicked out of him last night - and my home windows put through. anyway his face an hand and back are pretty fucked up are we entitled to compensation and how do we go about this? any websites or numbers you can give.

sorry to be blunt. but if we can get money from them it would be very nice thank you.

I'm sure you can get compensation as someone I know received some money for a black eye, it was a long time ago but I think its still available.

Do you know the people that did it?

sounds dreadful. Were the police involved - surely they would be able to offer you support & advice re: prosecution.
I'm no expert but I think for compensation you have to press civil charges against the attackers rather than criminal charges.

Would your house insurance pay up over the windows & other damage ?

I may be wrong hopefully someone else can give you more informed advice. I only know about health & safety law I'm afraid

fine thanks. was trez scared as dh was in a&e when winders went through and was on mi own with kids upstairs and fcking pertified.
phoned 999. police have been involved - got phone call saying dh is being accused of assault. not sure which one of the 4-6 lads who attacked him is alleging this.

i digress.

think i will need a no win - No fee solicitor jobby then eh?

Possibly - although they usually say hurt or injured in an accident that's not your fault, so not sure how assault fits in there. God, you must've been scared

If you're really lucky maybe you'll get it at about 50p/week (this was how my DB got some compensation many years ago when the perps were ordered by court to pay it). Hope the system has changed now as it must be a worse admin nightmare than the CSA.

I think that someone has to be charged for you to get compo. I had a leaflet sent to me when we were having all the trouble here last year, about compo. and it said that someone has to be charged..

Please be very careful with the no win-no fee types. You often end up with very little actual cash. I know of cases where people were awarded over £7000 & they actually only ended up with £1000.

Possibly seek free advice from CAB first as to the best way to go

My dh was attacked a few years ago, the Police sent Victim Support volunteer to our house and they helped dh to claim compensation through them, hope your dh recovers fully! HTH

They cannot sue him, he was acting in self-defence. Their case would be thrown out of court. 2 out of the 6 beating him up want to sue? I don't think so! Take photos of his injuries when the bruising shows, their case really will be laughed out.

They will be taken to court, he will need to identify them, witnesses would be good (including yourself), they'll be found guilty no doubt and will either be sentenced or have to do community service. Compensation will be ordered but I presume they are jobless in which case you probably won't get anything I'm afraid. Not out of them that is, but if your dh is covered (and this could be on the house insurance) then your insurance company should pay up. Look into it.

Will ring you this week. Remember the photos, they will come in very handy in court.

No advice Custy - just for you.

Dh did get some compo once from the Criminal Injuries after being assaulted on duty but TBH it was a pittance (about £50) wasn't worth the aggravation. I'm not sure if we actually received any of it come to think of it.

My brother was beaten up in the park about 4 years ago Hewas 20 at the time and after much wrangling and loads of hassle he got about 4k and that was with having had a small bleed in his head and a couple of weeks in hospitalso it is a lot of effort for not much gain

I took a boy to court once. I was pushing dd in her buggy in the railway station, about 6 lads were messing about, swearing and throwing punches to each other. Then 2 of them got into a scrap right in front of me and nearly tipped dd out of her buggy. I was livid, but when I confronted them they told me to fuck off and piss off (dd was 2 years old and watching everything). I went straight to the guard and told him and I identified the one who had nearly tipped dd over and who had sworn at me. He saw me in the streets a few times and shouted 'bitch' at me. I took him to court, he never bothered showing up, he was sentenced to do community service (it wasn't his first offence) and to pay me £50 compensation. I got a fiver.

It's worth the hassle so they know that not everyone will be intimidated.

Get them sentenced and see if your insurance will pay out.

dh is in the bath. he was proper battered. the policeofficer dealing with it doesnt come on duty til 11pm tonight. then she is off for 4 days. cant believe it. no one will take a fucking statement.

anyway - just wanted to say thanks for those links - and for the stories, helps me get perspective when i eventually make a decision

Have you taken piccys? You must. My brother, whos mentally ill, but thats beside the point was jumped for his 90 quid trainers. They broke his jaw and he got 3 grand.
