if i've ordered something at on price and they have taken the money for that price stated.....

can they refuse to send goods if the price is an error? even tho it has been charged to my card and payment has gone out?

Have you looked at the small print in their Terms and Conditions, most of the bigger companies have a clause concerning pricing errors.

Has the payment gone from your card account and have the goods been despatched?

having run a retail business for many years, if they've advertised it at the incorrect price then they are not obliged to sell it to you at that price, although they should amend their advertising IMMEDIATELY.

its common practice though (and i have done this) to sell the product at that price to 'you' and then change the price for future customers.

as they have already billed you then i would expect them to foot the losses and send you your stuff. it's not your fault that they misadvertised and didn't realise until it was too late.

oh and check they've updated the advertised selling price......if they haven't tell them you'll report them to trading standards.

well it was 28" TV with dvd player and stand for 49p!!

its not coming up as an error on the page. but my card has been debited £5.44 (£4.95 p and p), and i have had email conformation of the order as well.

I really dont expect to get it btw.

it was with homebase. the tv can no longer be added to the basket. i have an email which reads

Your order number is **. Please keep a note of this number until your order arrives. This email is only an acknowledgement of
receipt of your order which has been passed to our team to be processed.

and the money is going out of my account (but hasnt yet cleared IYKWIM) i use internet banking so can see that the payment is waiting to go. it has left my account but not yet got to them.

I could be wrong on this, but my understanding of this was that you were entitled to the goods as priced if it could be reasonably expected that the goods could be that price.

As I say, I could be wrong, but I wouldn't expect to get a tv for 49p!!!

I did however get a bargain portable stereo that a shop assistant had inadvertently put in the sale instead of its cheaper relation - took them ages to work out why they couldn't fit it in the box!! (doh!)

i told peter about it, he asked if it was 14" one, he sounded shocked when i said it was 28" widescreen lol.

Have a look at Kodak website price mistake from 2002, misdee.

Kodak did honour the orders in the end but it was a less obvious pricing mistake than yours. Might be worth mentioning it to Homebase/Argos though.
