CMS - no payments

So just need some clarification/advice if possible.

I put a claim in for child maintenance and chose the collect and pay option as I knew my ex would not pay on time or pay at all. So far, he’s not paid anything and missed two payments already (not a shocker, was expected, was exactly why I chose the collect and pay option).

I’ve done some research and found online that payment can be deducted through his earnings. When exactly does this happen?

He’s already missed two payments. He’s going to miss every other payment so why can’t they just put the deduction from earnings order in place now?

Have you contacted CMS and told them no payment has been made? They will approach his employer and ask them to make the deduction direct from his wages. Be warned it does not always happen in a timely manor. I’ve always found them really helpful in the phone. Although I’m currently owed £30k. So the system is very flawed.

They already know as collect and pay means they are meant to receive the payment first then pass it on to me. But I will give them a call on Monday and ask about it.

It takes months for them to set up a deduction of earnings, and my absolute prince of an ex then goes on ‘benefits’ aka cash in hand to dodge that as well, sounds like it might happen here as well if he’s not bothering to make payments.

Despite them identifying the pattern of avoidance of paying years ago, they do absolutely fuck all, and so the cycle continues. It’s disgusting. Both from him (obviously) and from the CMS.
