Judge ignoring caffcass safeguarding letter

Katisha111 · 06/12/2024 17:41

Had my emergency court hearing today because caffcass officer has sent them safeguarding letter with recent incidents caused by my ex.
Judge completely ignored caffcas safeguarding letter. I am planning to appeal against it. Has anyone got same experience?

What do you mean ignored it? No action no comment? Did you bring it up in court? Serious safeguarding or my child was wearing odd socks? How serious?

What do cafcass say?

The safeguarding was his mental state, abuse of prescribed cannabis, his complaints that when child is ill and needed antibiotics. Very abuse and hostile FB posts where he fully named our child and the abuse was towards myself. He has telling off for mentioning court proceedings and our child in his FB post but court is not taking safeguarding letter into the account. I feel like judge has rushed this hearing. Even my barrister was speechless and will instruct solicitor on Monday to appeal against judges decision.

Sorry caffcass said to stop the contact between my child and her dad and that she needed to do further assesments and in her opinion what I mentioned before was a safeguarding issue.

No I've not had exactly that, but your situation sounds very similar to mine. Even down to the talking about the court process on the Internet.
Do you have confidence in your solicitor? Barrister? Did they push the importance of the safeguarding letter?
How old is the child?

Hi my lovely.
I am a legal aid customer unfortunately my solicitor keeps passing me to different barristers at each hearing there is no consistency I don't know if as a legal aid customer I can change solicitors and if I will benefit from it looking that I am awaiting final hearing in February.
Yes we tried to explain the importance of the safeguarding letter the risks but he classes that as an adult argument rather safeguarding issue. I am appealing against his decision today.

You are still entitled to a certain level of care regardless.
I was also a legal aid customer, I had the same solicitor through out!
Have they talked about having a fact finding hearing? This was something I had, social services were saying it wasn't necessary and to allow the father unsupervised contact. I disagreed and my solicitor asked for a fact finding/Scott's schedule.

Katisha111 · 09/12/2024 14:47

We have done the Scott Schedule court and caffcass are satisfied there is no need for facts findings but in the mean time he has been arrested for harrasment and case is with CPS at the moment I am still awaiting their decision. All I know the two day trial will take place soon and he will be able to cross examine me. It's like never ending battle.
