CMS MISSED PAYMENTS & ARREARS

Hi!

I have 2 questions about Child Maintenance.

  1. My ex was paying child maintenance by direct pay each month but he is refusing to pay his final payment due 01/01/2024.
    I've spoken with CMS on the phone a few times and on two occasions case managers sent him text messages saying he owes for a missed payment and requested it is paid. Of course he ignored this and still hasn't paid.
    I decided that my best option (after informing CMS about the missing payment) would be to switch to Collect & Pay and hopefully that will help recover the payment he owes. I requested this change via my online CMS account and it is showing as still processing. I'm not expecting this to be done with any speed judging by how long it takes for the CMS to do most things.
    Has anyone been in a similar situation and been successful or have any advice or suggestions that would help me in any way please?

  2. I also chose to switch to Collect & Pay to help me with the arrears owed on the case. I believe the arrears are just under £500 last time I checked and I'm curious if anyone has successfully received arrears they were due??

Hi. It shouldn't be a big deal if he's employed! My ex husband owes £7,000! But will various reasons I know I won't see that money.
I think cm will expect him to pay the arrears of a bit at a time.

my ex stopped paying aug 2022 took cms till sep 2023 to sort collect n pay he owes 3500 arrears im going to try and get them to enforce action they're useless

I've never er had this. Request to speak with a manager. I think it will be added to your balance when you have you're yearly review OP.

You can also challenge a mandatory reconsideration, then it's the courts who look into matters. I'm at this stage now I applied last year, I am still awaiting a court date!

I was told that they will not switch to collect and pay unless 3 payments were missed is succession .

I got the cms to agree to collect and pay but then ex paid arrears don’t stayed on direct payments
