Hi. Me & my ex separated last June, all 3 of the children stayed with me. In August last year DC2 went to live with him, their own choice. Ex refused to pay maintenance for dc1 & dc3 who were still in my care but said I could keep the child benefit I received for all 3 & he wouldn’t claim for dc2. I couldn’t be bothered with going to the csa for maintenance as he kept changing his job so just left it at that. In July this year I decided to start claiming maintenance for dc1 & dc3 which is substantially more than what I get in CB, in August this year dc2 came back to live with me. I’ve received 1 maintenance payment from ex, which he really begrudges paying, & he has now put in a claim for CB for the year that dc2 was living with him & in the meantime my payments have stopped. Am I going to be prosecuted for fraud for still receiving it for dc2 even though that’s what we agreed. Any help/advice much appreciated. Thank you

Cant imagine they'd prosecute fir the sum involved. Anything you have in writing (even a text message) will help explain the situation. You may have to pay it back though.
All sounds a bit tit for tat between the two of you. Can you sort it out?
