CMS is a joke

Had to go to direct pay in the end for CM.
It gets paid a handful of times and now it’s over 2 weeks late.

Not one communication from CMS.

CMS are computerised, banking is computerised. It’s not rocket science to computerise dealing with late/non-payment, and letting the CM recipient know what’s going on.

Why do that, when CMS can just waste my time by me now having to case this up with them.

Bet CM payments would be sorted out straight away, never written off and charged interest ...if the recipients were mostly men.

I'm in court with the cms and my exh soon to challenge their decision.

I was watching something on tv where they said not paying child maintenance is illegal. It clearly isnt illegal. There seems to be no consequences for non payment. I was told they can take my ex to court once he owes over £500 but so far he only owes £140 apparently, despite not paying in 6 months. they must be adding it up at £5 a week 🤷‍♀️

Because it would've charged me to start a case and XH is self employed, there was no point in going through CMS for me, although XH does at least give me 50% of actual costs - school uniform etc, not actual costs of course.
Still not worth me paying to put a case through CMS for what he claims he earns!

Put in n official complaint, preferably through your MP (I just phoned up their office and it was his assistant who did all the work), it suddenly spurs them into action. When the official complaint was live they were desperate to help.

Do they take directly from your exes wages or expect him to pay them himself?

I don't get a huge amount, but it is better than nothing, he will also be paying arrears off until his children are long into adulthood.

ThatFalseEquivalenceTho · 10/03/2019 07:50

I’m owed over £3000.

I don’t understand why, if they know his employer, it is going to take months to do the DOE. Or why it’s a separate department with a separate DOE for arrears.

He fully deserves to go to the cash point on pay day to find 60% of his wages aren’t there because they have finally caught up with him.

Based on the most recent correspondence, I think the bastards have just waived away most of my arrears, despite my strict instructions not to do so. I don't know if I can face their sodding telephone system again, especially as there is a very little chance of exH ever paying off any of the arrears.

I paid for them to collect the money directly from him, but he fobbed them off by setting up a voluntary standing order of £30 per month. I have no way of checking it against his income, and obviously they don't care, as they can put him in their stats as a success story.

Quick update.
Feckless NRP is in the eyes of CMS, no longer working. This is why the CM stopped. NRP told them, but CMS didn’t bother telling me.

Don’t worry though, he’s working. Just not for a company who will declare his earnings to HMRC.

In my eyes non paying of CM is NRP purposefully stealing from their own DCs to spend it on themselves. Despicable.
CM being written off is the state enabling this criminality and is just as despicable.

AnnettePrice could you report him to HMRC for tax evasion? I hate it when these feckless nrps get away with stealing from their children.
