Moving from NZ to UK, visa advice?

My sister moved over to NZ 5 years ago, has residency, full time work etc, is living with her oh (a Kiwi), who she has a 1 year old daughter with. He is a Carpenter. Baby has dual nationality.

They want to move back to the UK early next year, but the complication is that he, whilst young and foolish, once turned up to the UK completely visa-less and so has it on record that he has once before been turned away. He then returned some time later with the proper paperwork and gained entry, got a job in a bar here (which is where they met) and stayed here until that visa ran out. They returned to NZ together.

Does anyone have any advice on how best to approach the application? it would seem straightforward if she were here settled with the baby already, and they were just applying for him to join them, but how do they go about applying all at the same time? Do they both need work arranged in advance? Or just one of them? Is there a lower limit they need to earn?

Is there anywhere over there (she is in Wellington) she can get advice that isn't going to cost a fortune?

We have gone round in circles online and never seem to get any clearcut answers!

Your sister's partner needs to apply for a UK visa on the basis of their relationship. It do not think it would matter that they are all currently in New Zealand, so long as they all arrive together. I've literally just done the reverse as I am a Kiwi and my partner is British, we both moved back to NZ together at the same time.

You can find details on the gov.uk website here - this has all the eligibility criteria including any financial requirements. You don't necessarily have to have a job lined up (I didn't find one till 3 months after I arrived in the UK) : www.gov.uk/join-family-in-uk

Hope that helps - all of the info is on the official website, just be wary of getting info online from non-official sources. It's fairly straightforward so long as they carefully read all the documentation they should be fine. I don't think it would matter that he was turned away from the UK previously if he subsequently gained a visa to at a later date.

Forgot to add, I'm assuming that while your sister has NZ residency, she has retained her UK citizenship. If baby also has dual citizenship then it really is straightforward as it's just your sister's partner who needs to sort out a visa.
