just had a car crash with uninsured person....not in fault but been told need to pay 400£ for excess???

hi, a car has bumped into me this morning while was waiting at traffic. not my fault at all, however the lady had no insurance...my insurance says that i need to pay 4003 excess because she has no insurance...completely appalled....what should i do?

are you sure that you are paying more because she was uninsured? check your policy - it may be that you have a £400 excess anyway. My insurance has a £500 excess which I would pay whenever I claim.

I would imagine that is your normal excess? In a situation where someone else is responsible, you claim that back from their insurance company, but if she's uninsured that obviously can't happen so i guess you have to pay.

I think if my memory serves me correctly, that there is a fund that exists for compensation in such circumstances, called the Uninsured Driver Scheme. I couldn't get the Motor Insurers' Bureau to work (!) but there are some details on Wikipeda. en.wikipedia.org/wiki/Motor_Insurers'_Bureau

Wiki could be out of date/wrong but something to look into.

I had my car written off by uninsured driver the MIB is a fund that is used for this purpose.

Do you have legal cover? Can they recover the excess from the woman rather than her non-existant insurance company? My mum had a similar problem, and did have to really push it with her insurance company, as it was easier for them to charge her the excess than chase it up legally, but they did in the end.
