Consumer rights ? Taking back a pair of shoes whihc after wearing one day discover are different sizes

Brought a pair of casual shoes last week from a well known chain of shoe shops. One on display wasn't my size so asked the assistant for my size 6.5. Tried them on , fitted ok . assistant took them off me and took them to till out in box , I paid and left.

Anyway after wearing them for one day I feel one is feeling a bit tighter than other and discover that oneis 6.5 the other is szie 6.

What would be my rights if I took them back ?
I have the recepit and shoe box which says 6.5. Should I have checked them or was it down to assistant ?

I would think that you would have no problem. It is totally reasonable for you to assume that they would give you a pair without you having to check that they matched. I'm not sure but it may be against the trades description act as they didn't sell you two shoes in a 6.5 as stated on the box.

I really think you will be fine. Shoe complaints usually only get tricky when people say "Oh, I'm always a size 6 but these really hurt" which isn't actually a fault of course. It can be hard to distinguish between a badly-made faulty shoe and a well-made but poorly fitting shoe.

no def take them back. it's their fault. I used to work for a well-known chain of shoe shops and we had to pair-check every single pair of shoes as they were sold (on pain of death)

it happens a lot, and you should have no problem getting your other 6.5 shoe, or getting money back

I've done this. They changed them without question. (Was Next), they had size 4.5 on the tags, I paid for them, wore them a couple of times, one seemed tight to I looked inside and it was a size 4.
