We cancelled a policy over the phone, they have 'no record' of call and will not refund :-(

We took out a credit card through my work (balance transfer for 12months 0%) we had to do it in DH name as he is main earner, when he phoned to activate the card and tell them details of transfer they sold him a identity protection policy. DH didnt really understand and agreed then mentioned it to me, no paperwork arrived so assumed it was cover included on the card. A month later we received a pack and a charge of £90 on the card. They apologised for delay in sending pack out and gave us an additonal 14 days cooling off period. DH phoned within that 14 days to cancel and we thought no more.

When we received next statement there was no refund so he phoned and was told the policy was not cancelled, they recancelled it and we had to wirte for a refund. They have now written to say they have no record of original conversation therefore they will not cancel policy and will not refund. We havent even activated the stupid thing so no use to us. Where do we stand on getting a refund as its their word against ours We cannot afford to lose £90 over this

hope you get some advice from legal types soon
I always thought when companies did this they sent a letter straight out confirming the details of your policy - do they have this letter?

sorry, talking rubbish, this would be the cancellation...difficult...

Thanks DH just got home and made him phone and do the ID bits and I spoke to them, they say they have copies of every call and no call was made and it's too late. The man I spoke to was sympathetic but said it was beyond anything he could do and to write another letter stating our case (the fact the card will never be used for purchases as it is simply to try and pay a huge chunk of the bill) sadly our phone bill is paperless and through our broadband provider so not sure I can prove the call was made (need to go and have a look if I can find itemised bill online)
I am going to mention in the next letter that I am an employee (although think my company pass our info onto this company as it appears not to be anything to do with my bank) I may try calling credit card people too so bloody annoying grrrrr
